நான் என்னிடம் உள்ள பழைய தங்கத்தை, புது தங்கத்திற்கு பகரமாக மாற்றிவிட்டு, மீதி தொகையை ரொக்கமாக கொடுப்பது அனுமதிக்கப்பட்டதா?

எல்லாப்புகழும் இறைவனுக்கே:
உங்களிடம் இருக்கும் பழைய தங்கத்தை கொடுத்துவிட்டு புது தங்கத்தை வாங்கி, மீத தொகையை ரொக்கமாக கொடுப்பது அனுமதிக்கப்பட்டது அல்ல. இது ஹராம் ஆகும். இதற்க்கு ஆதாரம் ஸஹீஹ் முஸ்லிமிலும், ஷஹீஹ் அல் புகாரியிலும், மற்ற ஹதீஸ் கிரந்தங்களிலும் வரும் ஹதீஸ்:
3248. அபூசயீத் அல்குத்ரீ (رضي الله عنه ) அவர்கள் கூறியதாவது:
பிலால் (رضي الله عنه ) அவர்கள் (“பர்னீ” எனப்படும்) உயர்ரகப் பேரீச்சம் பழங்களுடன் வந்தார்கள். அவர்களிடம் அல்லாஹ்வின் தூதர் (ஸல்) அவர்கள், “இது எங்கிருந்து கிடைத்தது?” என்று கேட்டார்கள். அதற்கு பிலால் (رضي الله عنه ) அவர்கள், “என்னிடம் மட்ட ரகப் பேரீச்சம் பழங்கள் இருந்தன; நபி (صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ) அவர்களின் உணவுக்காக அதில் இரண்டு “ஸாஉ”கள் கொடுத்து இ(ந்த உயர் ரகப் பேரீச்சம் பழத்)தில் ஒரு “ஸாஉ” வாங்கினேன்” என்றார்.
அந்த நேரத்தில் அல்லாஹ்வின் தூதர் (صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ) அவர்கள், “ஆ! இது வட்டியேதான்! இவ்வாறு செய்யாதீர்கள். நீங்கள் இந்த (உயர் ரக)ப் பேரீச்சம் பழத்தை வாங்க விரும்பினால் உங்களிடமுள்ள அ(ந்த மட்டரகப் பேரீச்சம் பழத்)தைத் தனியாக விற்றுவிட்டு, பிறகு அந்தத் தொகையின் மூலம் (உயர் ரகப் பேரீச்சம் பழத்தை) வாங்கிக்கொள்ளுங்கள்” என்றார்கள்.

ஆகவே ஒரே வகையை சேர்ந்த ஒரு உயர் தர பொருளை வாங்குவதற்காக அதே வகை பொருளை அளவில் அதிகமாக கொடுப்பது வட்டியாகும் என நபி صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ தெளிவு படுத்தினார்கள். ஆகையால் ஒருவர் இதை செய்வது அனுமதிக்கப்பட்டது அல்ல.
ஆனால் நபி صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ தன் வழக்கத்தை போல், இந்த வியாபாரத்தை செய்வதில் அனுமதிக்கப்பட்ட முறையையும் கற்றுக்கொடுத்தார்கள். ஒருவர் தன்னுடைய பழைய தங்கத்தை சந்தையில் ரொக்கத்திற்காக விற்று விட்டு, அந்த தொகையை கொண்டு மீண்டும் தான் விரும்பிய தங்கத்தை வாங்கலாம். இதுவே நம் நபி صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ காட்டிய வழிமுறை

Praise be to Allaah.
It is not permissible to exchange low-quality gold for good gold and pay the difference. This is haraam and is not permissible, and the evidence for that is the report narrated in al-Saheehayn and elsewhere in the story of Bilaal (may Allaah be pleased with him) who came to the Prophet (peace and blessings of Allaah be upon him) with some good dates and he said: “Where did you get these from?’ Bilaal said: I had some bad dates and I sold two saa’s of them for one saa’ so that the Prophet (peace and blessings of Allaah be upon him) might eat from it. The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Oh, do not do this, it is the essence of riba, the essence of riba.” So Messenger (peace and blessings of Allaah be upon him) explained that adding more to things that should be regarded as equal because of the difference in quality is the essence of riba, and it is not permissible to do that. But as he usually did, the Messenger of Allaah (peace and blessings of Allaah be upon him) showed him a permissible way. The Prophet (peace and blessings of Allaah be upon him) told him to sell the bad dates for dirhams, then use the dirhams to buy good dates. Based on this, we say that if a woman has low quality gold or gold that people no longer wear, she can sell it in the market, then take the money and buy good gold. She should do it in this way that was taught to us by our Prophet (peace and blessings of Allaah be upon him).

الحمد لله
” لا يجوز أن تبدل ذهباً رديئاً بذهب طيّب وتعطي الفرق . هذا محرم ولا يجوز ، ويدل لذلك ما ثبت في الصحيحين وغيرهما في قصة بلال رضي الله عنه : جاء إلى النبي صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بتمر جيد ، فقال له من أين هذا ؟ قال بلال : كان عندنا تمر رديء فبعت منه صاعين بصاع ليطعم النبي صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فقال رسول الله صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ( أوّه ، لا تفعل . عين الربا ، عين الربا ) رواه البخاري ( 3212 ) .
فبيّن الرسول صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أن زيادة ما يجب فيه التساوي من أجل اختلاف الوصف أنها هي عين الربا ، وأنه لا يجوز للمرء أن يفعله ، ولكن رسول الله صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كعادته أرشده إلى الطريق المباح ، فأرشده النبي عليه الصلاة والسلام إلى أن يبيع الرديء بدراهم ثم يشتري بالدراهم تمراً جيداً .
وعلى هذا فنقول : إذا كان لدى المرأة ذهب رديء ، أو ذهب ترك الناس لبسه ، فإنها تبيعه بالسوق ثم تأخذ الدراهم وتشتري بها ذهباً طيّباً تختاره ، هذه هي الطريقة التي أرشد إليها نبينا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ.
